GENERAL TERMS AND CONDITIONS
1. SCOPE OF APPLICATION
These general terms and conditions apply to any purchase of products from the online shop: www.aeschbach-chaussures.ch / www.koala.ch, the website belongs to Chaussures Aeschbach PLC, a company registered in the Commercial Register of the Canton of Geneva. The Aeschbach brand is the exclusive property of Chaussures Aeschbach PLC.
The specific conditions for the purchase of products on the website are set out below. Online product offers are only valid as long as they are visible on the website and within the limits of available stock.
2. CONCLUSION OF CONTRACT AND SUBSCRIPTION TO THE NEWSLETTER
A purchase contract is concluded between the parties when the online shop www.aeschbach-chaussures.ch / www.koala.ch has confirmed the order to the customer in written format. The order confirmation is sent to the customer by e-mail. From this point of time onwards, the customer is subject to these general terms and conditions.
However, we reserve the right to refuse the order at our discretion and without giving any reasons. In this case, the customer will be notified and any payments already made will be refunded. We can refuse the order if a payment is not authorised, if a product is not available in our warehouse or does not meet our quality control standards and therefore needs to be withdrawn, or if the customer does not meet the criteria set out in our T&Cs.
After confirming the order, the customer has the choice whether or not to subscribe to the newsletter. The newsletter will only be sent to customers who expressly request it. The subscription can be cancelled at any time and the details to do so can be found in the newsletters.
3. PRICES OF THE ARTICLES
The prices stated in the offer at the time of ordering apply. Prices are in Swiss francs and include all taxes (incl. 7.7% VAT, VAT number CHE-105.823.280). We reserve the right to change prices at any time and without prior notice and not to supply products with incorrect prices. However, we undertake to inform customers of any price differences and to offer alternative products. We may apply price reductions or promotions to our offer. These offers are only valid during the period they are published on the website and cannot be requested retrospectively. Discount or gift vouchers offered and distributed on the Website or through partner websites are only valid online under the conditions stated in the offer. These vouchers can only be used when placing an order and the field provided for this purpose must be used. Under no circumstances can a voucher be applied retroactively. Our customer service will be happy to assist you in such situations.
4. PRICE GUARANTEE
We offer price reductions or promotions at certain times of the year on selected products. The purpose of these price reductions varies but generally the aim is to offer the product at a more attractive price as the season comes to an end and the chances of selling it at the normal price diminish. Therefore, a customer who has bought a product at full price at a particular time is not entitled to compensation for subsequent price reductions. Moreover, customers who order on account, when returning a pair of shoes and then reordering the same pair, will not be refunded the first but the last price for that product, in order to avoid cases of abuse.
5. CHANGE OF ADDRESS OR NAME
Please inform us of any change of address or name before placing your order to ensure correct delivery of your parcels.
6. TRANSFER OF RISKS
The transfer of risks takes place when the goods are delivered.
7. DELIVERY AND TRANSPORT
We will endeavour to dispatch the goods as soon as possible i.e. no later than the working day following the day on which the order is placed. The delivery address must be in Switzerland or Liechtenstein. Please note that if you pay in advance by bank transfer, the ordered items will not be delivered until we have received full payment for the order. We therefore ask you to transfer the purchase price immediately after receipt of the order confirmation, but within three days at the latest.
Delivery is free of shipping costs (max. 15 items per order), unless otherwise stated in the product description and in the shopping cart. We reserve the right to split an order into several packages or to send several orders in one package with the same delivery address.
As a general rule, we only allow orders for products that are physically available in our warehouse to ensure prompt delivery. However, if we are unable to supply a product due to differences in stock levels, we undertake to inform you as soon as possible and offer you alternative products. In this case, a refund is always possible.
7.1 AVAILABILITY AND DELIVERY PERIOD
The delivery times indicated at the time of validation of your order are purely indicative. They are valid from the moment of the order or, in the case of prepayment, from the moment of receipt of payment.
We undertake to dispatch your order within two working days, given that all the items ordered are in our central warehouse. However, it is possible that some products may not come directly from our central warehouse and therefore an additional delivery time of 2-3 days to dispatch the order should be expected.
Depending on the availability of certain items in one of our external warehouses or due to periods of sale, longer delivery times may occur. For this reason, all information regarding delivery times is non-binding and can be subject to change at any time.
If we are unable to meet the provisional delivery date, the customer is entitled to cancel the order in writing to Customer Service.
7.2 INFORMATION ABOUT THE DISPATCH OF YOUR PARCEL
All items are sent by post. The General Terms and Conditions of Swiss Post PLC apply, which can be found on www.post.ch.
7.3 COLLECTION OF YOUR ORDER AT A CHAUSSURES AESCHBACH SHOP
If the customer has chosen this option, the order will be delivered to the chosen shop indicated as such under the delivery address. The customer can then collect the ordered products from the selected shop during the shop's opening hours.
8. NO OBLIGATION TO BUY, RIGHT OF RETURN
Satisfied or money back. For online orders, we commit to take back all goods within 30 days and refund the amount as soon as possible, usually within 2 working days of receipt of the return and only if the amount due has already been paid. However, any discounts, rebates, or gifts you may have received when purchasing the product will be deducted, as well as any delivery charges if they were included in the original order.
A refund can only be made if the returned items have not been worn, are complete and undamaged, are in their original packaging, are carefully packed in additional packaging (the shoe box itself cannot be used as postal packaging), have all labels attached and if the return instructions included in the package have been carefully followed. Please note that if you place multiple orders of the same item, the return will be deducted from the last order with that item.
Returns are completely free of charge. We will pay the postage costs for returning the products as long as you use the pre-paid return label. If you cannot find the self-adhesive label enclosed in your order, please email our customer service team at [email protected] and we will email it to you.
8.1 RETURN IN AN AESCHBACH SHOE STORE
You can also return the goods ordered online together with the return label to one of the Aeschbach branches. However, no refunds will be made in the shop. Simply find your nearest Aeschbach shop.
9. PAYMENT TERMS
You can pay for your purchases in the easiest way possible. Whether you pay by invoice within 20 days, by prepayment, by VISA, Mastercard, American Express or via your PayPal account with our secure electronic payment partner Datatrans and without additional fees. For credit card payments, no card data is processed or stored directly. Your data will be processed by the transaction partner. In case of a refund, we can credit the transaction almost immediately using the same payment method. You can also pay for your order in advance. If you choose this payment method, we advise our customers to make the transfer as soon as possible using the information received by e-mail, not forgetting to indicate the reference number in the field provided. Once payment has been received, the parcel will be dispatched the same day. Please note that we cannot withhold your order indefinitely and that we only reserve it for 3 working days. Therefore, we recommend you to make the transfer as soon as possible! In addition, you can pay with cash to your postman at the time of delivery or at the post office counter using the cash on delivery system. This service is charged by the Post Office at CHF 15.00 and is non-refundable in the event of a return. Please contact our customer service to use this payment method.

In the course of order closing a creditcheck is executed by Intrum AG. The purpose of this creditcheck is to avoid credit defaults and fraud as well as prevention of over-indebtedness and unauthorized claims. For this purpose required personal information such as name, address, date of birth, contact information (email, telephone number) will be submitted to Intrum AG. Additionally Data of the internet-protocol (IP-Adress, Used Proxy Servers, etc.) will be gathered by using a script and submitted to Intrum AG. Requests for personal information stored by Intrum AG can be raised at Intrum via request for information.
10. RESERVATION OF OWNERSHIP
We retain title of ownership to the goods delivered until full payment has been received.
11. REFUND IN CASE OF RETURN
The refund will be credited to your chosen payment method once the returned items have reached our warehouse in accordance with the terms set out in clause 8 of these T&Cs. You will then receive a confirmation email informing you that your items have been received and that a refund has been made.
If you paid by invoice and prepayment, the refund will be made to the account from which the transfer was made. If you paid with PayPal or a credit card, the refund will be made to the with these payment methods linked account.
12. PRODUCT WARRANTY
We grant a warranty for the delivered goods against hidden defects for a period of 2 years from the date of purchase. The statutory warranty for defective products applies. We explicitly reserve the right, in the event of reported and identified product defects, to replace the item given that stock permits to do so.
Items with a warranty are subject to the terms and conditions of the offer in effect at the time of purchase. We ask you to keep your receipt as a guarantee certificate. The guarantee does not cover normal wear and tear or the consequences of improper handling, failure to follow the instructions for use, improper care of the product or damage by the customer or defects caused by external circumstances. Worn, dirty or damaged items are excluded from the guarantee.
13. RESERVATIONS IN A CHAUSSURES AESCHBACH SHOP
Reservation requests to Aeschbach shops are possible for products that have the "In-Store Reservation" button on the www.aeschbach-chaussures.ch / www.koala.ch website. Once you have made a reservation request, you will automatically receive an e-mail confirmation of receipt of your reservation request.
After checking the reservation request, the customer will be notified by e-mail whether the product could be reserved or not. Upon receipt of the reservation confirmation, the product can be purchased in the branch concerned, within the specified period of time and during the opening hours. The price stated at the time of the online reservation applies.
14. DATA PROTECTION AND DATA ACCURACY
The Customer is bound to provide accurate and correct information for all means of payment. The use of false data or misuse of identity is considered fraud and is punishable under Article 146 or Article 147 of the Swiss Criminal Code and will be prosecuted.
All client data is treated as strictly confidential and we engage to comply with the ethical rules issued by the ASVPC as well as the applicable legislation, in particular with regard to data protection.
The data collected will only be used for the purposes of order processing, communication with the client, planning and evaluation of business activities and for marketing purposes as well as the design and development of services for the client and the creation of customised offers. By subscribing to the newsletter, the customer agrees to receive regular offers and to the use of his/her data. The customer can contact customer service at any time to unsubscribe from the newsletter.
15. JURISDICTION AND APPLICABLE LAW
These terms and conditions are governed by Swiss law. We reserve the right to change these terms and conditions at any time. Our online offer is directed exclusively to customers with a delivery address in Switzerland or the Principality of Liechtenstein.
